If you want to buy wine from us or use our web site you can only do so on these terms and conditions, and by registering on the web site or ordering via email or phone you are agreeing to be bound by them. We may change these from time to time by updating this page.

Age restriction

It is against the law in New Zealand for anyone under the age of 18 to purchase alcohol. By entering our website and placing an order you confirm that you are at least 18 years old.
If you are buying alcohol products as a gift - the recipient must also be over 18 years old.

Delivery

Delivery Charges - Delivery charges vary depending on the delivery area and how many cases you order. We also charge extra for rural delivery. Delivery charges are calculated by our delivery calculator on checkout. We reserve the right to add to this charge if for any reason our costs of delivering to your address are higher than calculated. Delivery times vary between regions but we will have your goods delivered to you within 7 working days of your payment clearing and usually much quicker. We will contact you if for any reason we cannot deliver your goods in 7 working days. At that point you may decide to cancel your order for a full refund or wait for your goods to be delivered.

Receiver Age - If on delivery our drivers are in any doubt about the age of the recipient, we will request some form of ID. If the person receiving the delivery is unable to produce an appropriate ID showing they are over the age of 18, unfortunately we will be unable to leave the delivery.

Receiver Intoxication - If on delivery our drivers believe the recipient of the delivery may be intoxicated we will be unable to leave the delivery.

Authority To Leave: If you check the Authority to Leave box during checkout you are warranting that the goods will NOT be accessed or received by minors in your household. If you are not home when we deliver we will leave the delivery in what we think is a safe place outside your house. If we can't find a safe place we will take the delivery back and deliver it another time. You can provide us with some instructions on delivery when you checkout from our website or when you email us your order. We can also deliver to your workplace if that is easier.

Customer Commitment

Quality - We are committed to the quality of our wines. If you buy any of our wines and you don't like a bottle, we will offer you another bottle or credit you the purchase price of that bottle within 90 days of purchase. If you have bought a whole case of one particular wine which you don't like, and provided you have only opened one bottle from the case, then we will replace the whole case with another product or refund you the purchase price, as soon as we have collected the rest of the wine from you.

Breakages - In the event that any of the bottles in your case are damaged, please let us know within 14 days and we will ship you replacement bottles or issue you with a full refund.

Availability - Winesale.co.nz is a "bin end" specialist which means we often retail wine which is in limited supply. If you order wine from us and we run out of stock, we may change some of the bottles without asking you. We will always change the bottles for equivalent or better quality bottles. If you ever have cause to disagree with our choice of replacements, we will take back the bottles and give you a credit, no questions asked. If we don't feel we can offer a suitable replacement we will ship your order without the products we can't supply.

Claiming under our Customer Commitment - If you need to claim under our Customer Commitment, then call us on 04 566 8015 or notify us by email on service@winesale.co.nz .

Customer satisfaction - If you are dissatisfied with our performance in any way, please contact our customer services department immediately at service@winesale.co.nz. At Winesale.co.nz, we aim to deal with all enquiries fairly, confidentially and quickly. We try to resolve most issues immediately, but where this is not possible, we will keep you informed about progress until a satisfactory resolution has been achieved.

Right To Terminate - This Customer Commitment is here for the good of all of our customers. If we feel that it has been abused, we reserve the right to close your account, by inactivating it, once we have met our obligations under this commitment. If we do inactivate your account, and you choose to make another purchase, whether through that account or any other, then our obligation to you for any claim will be limited to your statutory rights and we will not be bound to deliver our full Customer Commitment.

Prices and payment

All prices are quoted in New Zealand Dollars. Delivery is in addition to the product price. All prices include GST.

Price Comparisons - We use a number of price comparisons in our emails and on the website.

Estimated Retail Price -  Winesale.co.nz sell a number of wines which are not available elsewhere in New Zealand. These are wines that we either directly import from overseas or source direct from wineries and growers in New Zealand under our own label. The saving we make from doing this we pass directly on to you the consumer. The Estimated Retail Price is the price we believe a similar product would cost if it went through the traditional supply chain of winery → wholesaler/importer → retailer. We believe the Estimated Retail Price is a fair indication of what similar quality wines are retailing for in New Zealand.

Elsewhere Price - When we sell products which are available from other retailers in New Zealand we may use an Elsewhere Price Comparison. In this case the Elsewhere Price will be the price at which the same wine is available for sale from another New Zealand retailer. We will only compare our prices with national retailers or other retailers who will distribute their products throughout New Zealand. In all other ways we will endeavour to make sure the Elsewhere Price is a fair reflection of what the wine sells for in New Zealand. 

Our Price Was - Our Price Was represents a previously advertised, non-discounted price available from Winesale.co.nz for at least 14 consecutive days in the last 2 months. The new discounted price will not be active for more than 31 consecutive days without itself becoming the new non-discounted price.

Supplier Clearance Deals and Cancelled Export Orders - Occasionally we are offered products which are not part of our regular assortment for clearance by suppliers. These products will be advertised as specials using the Estimated Retail Price or an Elsewhere Price comparisons. These products are advertised as specials because they are available for a limited time and once they are sold out we are unable to buy anymore at the agreed price from the supplier. These sales will have a set end time. If the sale items have not sold out by the end of the sale period they will be introduced to our regular assortment at a higher price.

Advertistng Price Discounts - It is illegal under New Zealand law to advertise price discounts on alcoholic products of 25% or more OR to place an advertisement that may lead consumers to believe they are recieving a discount of 25% or more. This restriction applies to all external marketing such as email, social media marketing, newspaper, television and radio. It does not apply to discounts offered within our website. Our website will dispay the full discount available on each product. All listed discounts will be in compliance with the NZ Fair Trading Act.

Payment

We accept payment by Visa, Mastercard, American Express and direct credit to our bank account. All payments will be processed in NZD.
We will not ship goods until your payment has cleared.
We reserve the right to terminate any special offer at any time, without notice.

Returns

If some or all of the bottles of wine in a case are broken or spoiled when they are delivered you should notify us as soon as possible. You may choose either to return the whole case or just the affected bottles for a refund or replacement.
We have a 90 day return policy which means you can return any wine for any reason within 90 days of ordering the wine. Winesale will organise the pick up of the wine using our usual courier partner from your place and cover the costs of the pick up. Winesale will not cover the costs of returning the wine (if any) if you choose to organise the return yourself. 
In the case of a negotiated sale or return deal for weddings or large functions you can choose to return the wines to us at your own cost or Winesale will organise the pick up of the wines and the cost of returning the wines will be deducted from the refund for the returned wines.
All refunds will  paid within 30 days of you notifying us of your wish to return wine under that clause, provided the wine has been collected by our carrier.
Nothing in these Terms and Conditions will reduce your statutory rights relating to faulty goods.
Purchases may be cancelled free of charge before they are shipped away. In this instance, refunds will be processed within 7 days of you notifying us.

Warranties

We warrant that the wines will be of satisfactory quality and fit for their general purpose.

Limitation of liability

You agree that Corporate Direct Wines 2008 Ltd will be not be liable for any loss or damage caused by us or our employees or agents in circumstances where:

  • Loss or damage was not foreseeable to both parties when the contract was formed;
  • Loss or damage was not caused by any breach on the part of the supplier;
  • Loss or damage relates to business and/or non-consumers.
  • We will not be liable for loss or damage caused by the customer handling the wine. In particular we will not be liable for spillages or breakages.

Customers should also be aware of the following inherent risks and warnings:

  • Alcohol should be consumed in moderation.
  • A case of wine is heavy so extra care should be taken when lifting it. If you are concerned about the weight we advise that you transfer the bottles 1 or 2 at a time.
  • Red wine in particular may cause staining if spilt so extra care should be taken.
  • Sparkling wines and champagnes can be volatile due to the build up of gasses extra care should be taken when opening these.

Data Protection

By providing your details to Winesale.co.nz on our web site or via email, you consent to us maintaining, recording, holding and using the information you give us at the time of ordering to process your orders, to improve our service to you and inform you of promotions.

Winesale.co.nz Privacy Promise

We take your privacy very seriously and will not pass your details to any third party without your permission, other than where we have to do so to get your wine to you, e.g. our delivery company.
If you opt-out from hearing from Winesale.co.nz you will not hear from us unless it is regarding a specific order made by you or unless we make an important update to our Terms and Conditions.

General

We shall not be liable for any delay in delivering your wine if that delay or failure is caused by circumstances beyond our control such as, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, fire, flood, storm or Act of God, failure of ISP or telecommunications provider in connection with the performance of this Agreement.
Winesale.co.nz may change or add to these terms and conditions for security, legal or regulatory reasons.
Relevant New Zealand law will apply to these terms and conditions and the relevant courts of New Zealand will have exclusive jurisdiction.
